Supreme Court Cases; 2003-2004 Term

The 2003-2004 U.S. Supreme Court term included several cases addressing a variety of constitutional criminal procedural issues, some dealing with the most fundamental of law enforcement activities. One case resolved the constitutionality of a state's identify yourself statute, requiring individuals to identify themselves during an investigation detention. The Court also rejected a rigid approach to determining whether a reasonable period of time has lapsed prior to making a forcible entry. A few vehicle cases were reviewed, including one addressing the scope of the search incident to arrest when the individual already was out of the vehicle when the law enforcement encounter began and the other relating to highway checkpoints. The Court addressed the constitutionality of arresting several companions when information suggests at least one may be involved in criminal activity. Custodial interrogation matters also went before the Court, including the constitutionality of an interrogation technique described as the ask now, warn later approach and the admissibility of physical evidence derived from a confession obtained in violation of Miranda. Additionally, the concept of deliberate elicitation within the meaning of the Sixth Amendment was clarified. The following is a brief synopsis of these cases. As always, state and local law enforcement agencies must ensure that their own state laws and constitutions have not provided greater protections than the U.S. constitutional standards.

Bush Budget Calls for Law Enforcement Cuts
$600 million grant program for local police agencies to $60 million next year
President Bush's budget will propose slashing grants to local law enforcement agencies and cutting spending for environmental protection, American Indian schools and home-heating aid for the poor, The Associated Press learned Saturday.
Bush molded the roughly $2.5 trillion spending plan for 2006 as a response to a string of record federal deficits, and is sends it to Congress on Monday.

FBI shuts down unclassified e-mail system
Agency investigating possible security breach
The FBI said Friday it has shut down an e-mail system that it uses to communicate with the public because of a possible security breach.
The bureau is investigating whether someone hacked into the www.fbi.gov e-mail system, which is run by a private company, officials said.
"We use these accounts to communicate with you folks, view internet sites, and conduct other non-sensitive bureau business such as sending out press releases," Special Agent Steve Lazarus, the FBI's media coordinator in Atlanta, said in an e-mail describing the problem.

More than a decade after the convictions, two detectives still fight for justice in nightclub case
The events unfolded in a matter of seconds, but the mystery has lingered for 14 years. The bullets hit two people, but dozens more, one by one, were drawn into this intricate tale, unable to let it go. Investigations were launched. Careers ended. And two veteran homicide detectives sworn to uphold the justice system questioned their faith in it.
It all began on a frigid Thanksgiving night in 1990. It was "Latin Night" at the once popular Palladium nightclub in Manhattan. At about one a.m., shots rang out at the velvet ropes and two bouncers were hit. Marcus Peterson, an amateur bodybuilder and neighborhood football coach from Brooklyn, was only 23 when he was murdered. Thirty-one-year-old Jeff Craig, a former NYC police officer, was wheeled away with a bullet in his thigh.

North Korea threatens: U.S. bases 'sea of fire'
U.S. military bases will become a "sea of fire" if war breaks out on the Korean peninsula.
That's the latest threat from North Korea, while South Korea says close to 700,000 American troops would be sent to the region.

Terror recruitment on the rise in Europe
What do recent arrests say about al-Qaida and Europe? In France, Tuesday, security agents detained seven people suspected of helping funnel Islamic militants into Iraq. In Mainz, Germany, this weekend, police arrested an alleged al-Qaida operative who is also accused of recruiting for Iraq. Crown Prince leads tough campaign
Saudi Arabia's crown prince has called for the creation of a worldwide center to share intelligence on terrorism at a conference on fighting al Qaeda and other groups.
Crown Prince Abdullah, who is the kingdom's de facto leader and has led a tough campaign against militant groups over the past year, said Saturday a global intelligence-sharing center could allow experts and officials worldwide to "exchange information instantly" to prevent attacks.

Militants Threaten to Kill Journalist Islamic militants have threatened to kill an Italian journalist abducted in Iraq by Monday unless Italy agrees to withdraw its troops, according to a statement on the Internet.
The statement, which appeared Saturday on an Internet bulletin board that serves as a clearinghouse for messages from extremist groups, said Giuliana Sgrena, 56, would be subjected to the "rule of God," a phrase that usually means punishment by death in the lexicon of Islamic militant groups.

The NightWing by MOD

Back in October of '04 I attended a Writer's Conference hosted by BlackHawk Products Group wherein they displayed new products that they were coming out with. Each Brand Manager took a few minutes to familiarize a room full of writers (rough crowd) with the new items, or upgrades to products, planned in the brand they handle. Now any of you who read these evaluations on a regular basis know that I'm somewhat of a knife nut. I like my cutting tools. On that day, Jim Ray, Brand Manager for Masters of Defense (MOD) showed us all a prototype knife called the NightWing.
The NightWing is a fixed blade knife that has a similar visual flavor to the Yarborough and Neil Roberts knives, but unique at the same time. Designed by Allen Elishewitz, the blade sports three options for the spine and a softly curved handle that feels ergonomically perfect in my hands.
